Incident location: Sea Reach Ball
Date: March 13th
Time: Aprox 7 pm EST
Charge: Assault
Victim: Duchess Molly of luna
Accused: Lord isk of Magincia
Witnesses: Archmage of H*G
Arresting officer(s): Lord Kotare, Duke of BlackWind, Sir Sid, Knight of BlackWind
In the early evening of March 13th, shortly after the BlackWinds knighting ceremony. A ball was held in Sea reach for all invited guest. It was during this ball that a situation developed between Duchess Molly of Luna and Lord Isk of Magincia.
As I pressed for information, Molly was given a cake from Lord Isk and became quite ill afterwards. Ill enough to the point where she regurgitated her food and some of it landed on Lord Isk. Isk and Angelique (defendant's wife) left the scene, though before leaving, Lord Isk stated that the act was degrading and seemed quite upset. They left to get him a change of clothes and then returned. They were gone for a period of five minutes. Upon their return, Isk made his way to the balcony where Duchess Molly was located and two members of Humanis (names were not given, though one is his council in this case) began to block access to the balcony. It was the gesture of blocking access to the balcony that caught my personal attention. After ordering the two members of Humanis to vacate the doorway, one proceeded to the balcony while the other refused to move. At this time the Sheriff was not present and thus powers of arrest fell upon myself and Sir Sid who are charged with the defence of Yew. After granting Sir Sid permision to use nessesary force if needed, the two guarding the door began to move out of the way.
Once we made it out to the balcony, I noticed Molly slumping forward in her seat with Lord Isk right behind her. I did not physically witness any attack, but given the position of Molly, Isk and the witnesses in question, I came to the conclusion that Molly was somehow assaulted by Lord Isk. But given that my perseption is not sufficient enough to arrest, I questioned Molly while keeping Lord Isk close by. It was determined that Molly was bleeding from the back of her head but was conscious at the time of inqury. She stated that she was attacked by Lord Isk and that one of her knights (Arcmage) had witnessed Lord Isk use the butt of an axe on her. When asked what kind of axe it was, Carmage stated the following: "it looked like the kind you cut wood with" This baffles me as all axes are ment to be used in such ways.
With a witness, a conscious victim's statements, I had sufficient evidence to detain Lord Isk on sight. He was taken to BlackWind Headquarters and placed in a cell for temporary holding. He was read his rights and was allowed to chose council (defence council is Stephen of Humanis). Lord Isk request that he have a human judge and thus, I assume the Magistrate will be the judge in this case.
Bail: As the magistrate was not available at the time of arrest. Bail became an issue for the defendant and so I looked at our Duchess to determine Bail setting. As she spoke with molly more so than I, she ordered bail set at 500,000 gold coins. I reminded her that the charge is Assault and that setting was a bit high. She replied, he is a foreigner and a flight risk. As the Duchess' word can not be challenged without the council's consent, I returned to Lord Isk and anounced the bail. Angelique returned with the correct sum of gold and Lord Isk was set free on bail.

I myself have a direct conflict in this issue as I have both respect and admiration for Lord Isk. Each time I have approached Lord Isk, I have addressed him accordingly. He requested that I do not call him lord as Lords are not placed in prison.
I was unable to question Lord Isk as at the time of arrest, he did not have proper council. However, he does admit the crime, in his terms, it was "trivial." This was stated through casual conversation.
A date needs to be set by the magistrate, in which all parties involved may attend trial to resolve this issue. |
